Summary

PURPOSE OF PUBLIC NOTICE

This notice serves to state the intention of the U.S. Environmental Protection Agency, Region 6, (“EPA Region 6”) to issue three (3) Underground Injection Control (UIC) Class VI injection well permits under the authority of the Safe Drinking Water Act (SDWA) and UIC Program regulations [40 CFR Parts 124, 144-146].

PERMIT INFORMATION

The proposed Class VI permits are for three (3) Class VI injection wells (BRP CCS1, BRP CCS2, and BRP CCS3) that will be used to inject carbon dioxide for the purpose of geologic sequestration near Penwell, Ector County, Texas. The proposed permits require, among other things, that the permittee monitor the injection project and submit periodic reports to EPA Region 6. Ongoing monitoring requirements are designed to ensure protection of underground sources of drinking water.

PUBLIC ENGAGEMENT MEETING

EPA Region 6 will hold a public engagement meeting on October 2, 2024, from 7:00 p.m. to 9:00 p.m. CST at the MCM Elegante Hotel, 5200 East University Boulevard, Odessa, Texas 79762. This meeting is open to the public and will provide general information on Class VI wells, the Class VI permitting process, and the proposed Class VI permits.

In accordance with the requirements of 40 CFR 124.10, the public is invited to comment on these draft Class VI permits by:Submitting written comments online at https://www.regulations.gov/docket/EPA-R06-OW-2024-0410 under Docket #EPA-R06- OW-2024-0410.Providing oral comments at a public hearing scheduled to occur from 11:00 a.m. to 2:00 p.m. Central Standard Time (CST) and from 6:00 p.m. to 9:00 p.m. CST on Thursday, October 3, 2024, at the MCM Elegante Hotel, 5200 East University Boulevard, Odessa, Texas 79762. Speakers will be invited to comment on a first come, first served basis dependent on the order of in-person signups. Speaking times will be limited and will be determined by the hearing officer on the day of the hearing. Pre-registration for the public hearing is not required but is requested by close of business Friday, September 27, 2024, solely so that we may ensure adequate resources are available. Note that pre-registration is NOT a guarantee of the opportunity to speak or of speaking order – this will be determined by the order and number of in-person signups.
